  • In a restroom, bathroom, locker room, bathroom or other locations where the person has a reasonable expectation of privacy and the person is urinating, defecating, dressing, undressing, nude or involved in sexual intercourse or sexual contact
  • In a manner that directly or indirectly captures or allows the viewing of the person’s genitals, buttocks, or female breast, whether clothed or unclothed, that is not otherwise visible to the public
  • It is unlawful to disclose, display, distribute, or publish a photograph, videotape, film, or digital recording made in violation of subsection A of this section without the consent or knowledge of the person being depicted.

Surreptitious photographing carries a mandatory prison term of .33 years to 3.75 years, discretionary if violation was committed with device or whether victim is recognizable. Probation IS eligible for this offense but NOT to a lifetime term. Registration as a sex offender is discretionary for this offense.

What are Arizona Consequences for Taking a Child for The Purpose of Prostitution

Taking a child for the purpose of prostitution is defined as taking a minor from the person who has legal custody of the minor for the purpose of prostitution. Taking a child for the purpose of prostitution carries a mandatory prison term of 1 year to 2.5 years. Probation IS eligible but can NOT be a lifetime term. Registration as a sex offender IS mandatory.

Taking a child for the purpose of prostitution if victim under 15 is defined as taking a minor from the person who has legal custody of the minor for the purpose of prostitution and minor is under 15. A person commits child prostitution:

  • Causing any minor to engage in prostitution
  • Using any minor for the purpose of prostitution
  • Permitting a minor who is under the person’s custody or control to engage in prostitution
  • Receiving any benefit for or on account of procuring or placing a minor in any place or in the charge or custody of any person for the purpose of prostitution
  • Receiving any benefit pursuant to an agreement to participate in the proceeds of prostitution of a minor
  • Financing, managing, supervising, controlling or owning, either alone or in association with others, prostitution activity involving a minor
  • Transporting or financing the transportation of any minor with the intent that the minor engage in prostitution.
  • Child prostitution carries a mandatory prison term of 7 years to 21 years if offense if committed before July 24, 2014. Prison term is 10 years to 24 years if offense if committed after that date. Probation is NOT eligible for this offense. Registration as a sex offender IS mandatory for this offense.

Child prostitution engaging in prostitution with minor, who defendant knows is 15, 16, or 17, defendant at least 18 years of age is defined as: prostitution means engaging in or agreeing or offering to engage in sexual conduct under a fee arrangement with any person for money or any other valuable consideration. Knowledge that the minor is 15, 16, or 17 is a required element. For offense committed prior to July 24, 2014 defendant would be subject to an enhanced sentencing range if he has one historical prior felony conviction for a violation of this section, as of July 24, 2014 defendant is subject to an enhanced sentencing range if he has one historical prior felony for any felony offense. Child prostitution carries a mandatory prison term of 7 years to 21 years and if convicted with prior, prison term is 14 to 28 years. Probation is NOT eligible for this offense. Registration as a sex offender IS mandatory.

Child prostitution engaging in prostitution with minor who is 15, 16, or 17, defendant has NO knowledge is under 18 is defined as, prostitution means engaging or agreeing or offering to engage in sexual conduct under a fee arrangement with any person for money or any other valuable consideration. Defendant need not have knowledge that the minor is 15, 16, or 17. Probation IS eligible but not a lifetime term. Registration as a sex offender is NOT required but court can order registration if a finding of sexual motivation is made.

What are consequences for failure to register as a Sex Offender?

Failure to register as a sex offender is described as a person who is required to register within ten days after the conviction or adjudication or within ten days after entering and remaining in any county of this state, shall register with the sheriff of that county. Probation Is eligible up to a lifetime term. Registration as a sex offender may NOT be required, dependent on original conviction.

Failure to notify Sheriff of a change of residence, address, name is defined as failing to notify the Sheriff in person and in writing of a change of a:


  • Change in residence within the county (residence is dwelling place, whether temporary or permanent)
  • Change of address (location where person receives mail)
  • Change in name

The defendant must have “actual knowledge of the need to register” or “proof of the probability that he had knowledge of the requirement” to be convicted of this offense. Probation IS eligible up to a lifetime term. Registration as a sex offender IS mandatory.

Failure to register every 90 days, if no residence or if more than one residence is defined as failing to register with the Sheriff in person and in writing no less than every 90 days if:


  • Transient
  • If more than one residence
  • The defendant must have “actual knowledge of the need to register” or “proof of the probability that he had knowledge of the requirement” to be convicted of this offense. Probation IS eligible up to a lifetime term. Registration as a sex offender IS mandatory.


Failure to verify address is defined as a person who is required to register shall verify the person’s address if requested by the department of public safety pursuant to section 13-3827 subsection G, which requires DPS to annually verify the addresses of all sex offender registration records contained within the Arizona criminal justice information system.

Failure to obtain or renew identification card is defined as on the person’s initial registration date, and every year after the person’s initial registration, the person shall obtain a new driver’s license or nonoperating identification, valid for one year. Probation IS eligible but no more than 3 years. Registration is PROBABLY NOT required

Failure to confirm online identifier is defined as, on the person’s initial registration date, and every year after the person’s initial registration, the person shall confirm any required online identifier and the name of any website or internet communication service where the identifier is being used. Required online identifier is means any electronic email address information or instant message, chat, social networking or other similar internet communication name, but does not include a social security number, date of birth or pin number. Probation IS eligible up to a lifetime term for this offense. Registration as a sex offender IS mandatory.

Failure to notify Sheriff of a change in online identifier is defined as a person required to register as a sex offender shall notify the sheriff whether in-person or electronically within 72 hours after a person makes any change to any required inline identifier, and before any use of a changed or new required online identifier to communication on the internet. Required online identifier means any electronic email address information or instant message, chat, social networking or other similar internet communication name, but does not include a social security number, date of birth or pin number. Probation IS eligible up to a lifetime term. Registration as a sex offender IS mandatory.

Failure of employee or student at post secondary educational institution to notify the Sheriff of a change in employment status or enrollment status is defined as a student or employee of a post-secondary educational institutional who is required to register shall also notify the Sheriff of each change on enrolment or employment status at the institution. Probation IS eligible for this offense up to a lifetime term. Registration as a sex offender IS mandatory.
