What are Arizona violent crimes consequences for Burglary?

Burglary in the third degree is defined as;
  • Entering or remaining unlawfully in or on a nonresidential structure or in a fenced commercial or residential yard with the intent to commit any theft or any felony therein.
  • Making entry into any part of a motor vehicle by means of a manipulation key or master key, with the intent to commit any theft or felony in the motor vehicle. (13-506).
  • Burglary in the third degree is a class 4 felony. A class 4 felony carries a prison term of 1.5 years to 3 years for a non-dangerous offense. A class 4 felony carries a prison term of 4 to 8 years for a dangerous offense.
  • Probation IS eligible only for a non-dangerous offense.
Burglary in the second degree is defined as; a person commits burglary in the second degree by entering or remaining unlawfully in or on a residential structure with the intent to commit any theft or any felony therein. (13-1507) Burglary in the second degree is a class 3 felony. A class 3 felony carries a prison term of 2 to 3.5 years for a non-dangerous offense. A class 3 felony carries a prison term of 5 to 15 years for a dangerous offense. Probation IS eligible for a non-dangerous offense.

What are Arizona violent crimes consequences for Robbery?

Robbery is defined as; a person commits robbery if in the course of taking any property of another from his person or immediate presence and against his will, such person threatens or uses force against any person with intent either or coerce surrender of property or to prevent resistance to such person taking or retaining property. (Section 13-902) Robbery is a class 4 felony. This offense carries a prison term of 1.5 to 3 years. Probation IS eligible for this offense.
  1. Aggravated robbery is defined as; a person commits aggravated robbery if in the course of committing robbery as defined in section 13-1902, such person is aided by one or more accomplices actually present. Aggravated robbery is a class 3 felony. A class 3 felony carries a prison term of 2.5 to 7 years. Probation IS eligible for this offense.
  2. Armed robbery is defined as; a person commits armed robbery if, in the course of committing robbery as defined in section 13-902, such person or an accomplice:
    1. Is armed with a deadly weapon or a simulated deadly weapon: or
    2. Uses or threatens to use a deadly weapon or dangerous instrument or a simulated deadly weapon.
Armed robbery is a class 2 felony. A class 2 felony carries a prison term of 4 to 10 years. Probation IS eligible ONLY for a non-dangerous offense.

What are Arizona violent crimes consequences for Assault?

Assault is defined as;

  • Intentionally, knowingly or recklessly causing any physical injury to another person; or 
  • Intentionally, placing another person in reasonable apprehension of imminent physical injury; or 
  • Knowingly touching another person with the intent to injure, insult or provoke such person.
  • Assault committed intentionally or knowingly pursuant to paragraph 1 is a class 1 misdemeanor. 
  • This offense carries a jail term of 0 to 180 days. Probation Is eligible, unsupervised, up to 3 years. 

Assault committed recklessly pursuant to paragraph 1 OR assault pursuant to paragraph 2 is a class 2 misdemeanor. This offense carries a jail term of 0 to 120 days. Probation Is eligible, unsupervised, for this offense. Assault committed pursuant to paragraph 3 is a class 2 misdemeanor. This offense carries a jail term of 0 to 30 days. Probation IS eligible, unsupervised, up to a year.
